    Terms of Service

    Please read these terms carefully before using Booking Pro AI. By using our platform, you agree to be bound by these terms.

    1. Agreement to Terms

    These Terms of Service (“Terms”) govern your access to and use of Booking Pro AI™’s website, applications, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

    “You” refers to the individual or entity registering for or using the Service. “We,” “us,” or “our” refers to Booking Pro AI™.


    2. Description of Service

    Booking Pro AI™ provides an AI-powered communication and booking platform that enables businesses to:

    • Automatically answer phone calls using AI voice agents
    • Respond to SMS and WhatsApp messages automatically
    • Schedule and manage appointments via calendar dashboard
    • Manage staff/technicians, services, and availability
    • Maintain a customer contact database (CRM)
    • Configure AI receptionist personality, voice, and behavior
    • Access analytics, reporting, and business insights
    • Import and export customer data
    • Integrate with third-party calendars and services

    3. Account Registration

    To use the Service, you must create an account. You agree to:

    • Provide accurate, current, and complete information
    • Maintain and update your information as needed
    • Keep your password secure and confidential
    • Be responsible for all activity under your account
    • Notify us immediately of any unauthorized access

    You must be at least 18 years old and have the legal authority to bind yourself or your organization to these Terms.


    4. Acceptable Use

    You agree NOT to use the Service to:

    • Violate any applicable laws or regulations
    • Infringe on intellectual property rights of others
    • Send spam, unsolicited communications, or harassing messages
    • Transmit malware, viruses, or harmful code
    • Attempt to gain unauthorized access to systems or data
    • Interfere with or disrupt the Service or servers
    • Impersonate others or misrepresent your affiliation
    • Collect data from the Service without authorization
    • Use the Service for any illegal, fraudulent, or harmful purpose

    5. Your Responsibilities

    5.1 Customer Data and Consent

    You are the data controller for any personal data of your customers processed through the Service. You are responsible for:

    • Obtaining all necessary consents from your customers, including consent for call recording where required by law
    • Providing appropriate privacy notices to your customers
    • Complying with all applicable privacy and data protection laws
    • Ensuring you have the right to use customer phone numbers and contact information

    5.2 Telecommunications Compliance

    You agree to comply with all applicable telecommunications laws and regulations, including but not limited to:

    • The Telephone Consumer Protection Act (TCPA) in the United States
    • Do-Not-Call regulations and requirements
    • Call recording disclosure requirements in your jurisdiction
    • Anti-spam and messaging regulations

    5.3 AI Disclosure

    Where required by law, you are responsible for disclosing to your customers that they may be interacting with an AI system.


    6. Subscription and Payment

    6.1 Fees

    Access to certain features requires a paid subscription. Fees are listed on our pricing page and may include:

    • Monthly or annual subscription fees
    • Usage-based fees for calls, messages, and other services
    • Add-on features and premium support

    6.2 Billing

    You authorize us to charge your provided payment method for all fees. Subscription fees are billed in advance; usage fees are billed in arrears. All fees are non-refundable except as expressly stated.

    6.3 Price Changes

    We may change our fees with 30 days’ notice. Continued use after the effective date constitutes acceptance of new pricing.

    6.4 Free Trial

    We offer a 14-day free trial with no credit card required. You can try all features during the trial period. At the end of your trial, you will be prompted to add a payment method to continue on the paid plan. If you do not add a payment method, your account will revert to the free plan.


    7. Intellectual Property

    7.1 Our Intellectual Property

    The Service, including all software, content, designs, trademarks, and other materials, is owned by Booking Pro AI™ or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Service according to these Terms.

    7.2 Your Content

    You retain ownership of content you upload to the Service. You grant us a license to use, store, and process your content solely to provide the Service. You represent that you have all rights necessary to grant this license.


    8. AI Services and Limitations

    Our AI-powered features are designed to assist your business operations. You acknowledge that:

    • AI responses are generated automatically and may not always be accurate
    • You are responsible for reviewing AI interactions and correcting any errors
    • AI performance depends on the quality of information you provide (service descriptions, hours, staff availability)
    • AI receptionist personality settings (name, voice, greetings) are your responsibility to configure appropriately
    • AI cannot make legally binding commitments on your behalf beyond what you configure
    • You should have processes to handle edge cases the AI cannot resolve

    9. Third-Party Integrations

    9.1 Google Services

    If you choose to sign in with Google or connect Google Calendar:

    • You authorize us to access your Google account information for authentication
    • You authorize us to read and write calendar events for appointment synchronization
    • Your use of Google services is also subject to Google’s Terms of Service and Privacy Policy
    • You can revoke access at any time through your Google account settings

    9.2 Other Integrations

    The Service may integrate with other third-party services. Each integration is subject to the respective provider’s terms. We are not responsible for third-party service availability or changes.


    10. Service Availability

    We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

    • Scheduled maintenance (we will provide advance notice when possible)
    • Emergency maintenance or security updates
    • Circumstances beyond our reasonable control

    11. Termination

    11.1 By You

    You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

    11.2 By Us

    We may suspend or terminate your access if you violate these Terms, fail to pay fees, or if we cease offering the Service. We will provide notice when reasonably possible.

    11.3 Effect of Termination

    Upon termination, your right to use the Service ends. You may export your data for 30 days after termination. After that, we may delete your data according to our retention policies.


    12. Disclaimer of Warranties

    THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    We do not warrant that the Service will be uninterrupted, error-free, secure, or meet your specific requirements.


    13. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKING PRO AI™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION.

    OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.


    14. Indemnification

    You agree to indemnify and hold harmless Booking Pro AI™, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

    • Your use of the Service
    • Your violation of these Terms
    • Your violation of any third-party rights
    • Your customer data and how you process it
    • Your failure to comply with applicable laws

    15. Dispute Resolution

    Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial and to participate in class actions.

    These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.


    16. General Provisions

    • Entire Agreement: These Terms constitute the entire agreement between you and Booking Pro AI™ regarding the Service.
    • Modifications: We may modify these Terms at any time. Material changes will be communicated with 30 days’ notice. Continued use constitutes acceptance.
    • Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
    • Waiver: Failure to enforce any right does not waive that right.
    • Assignment: You may not assign these Terms. We may assign to an affiliate or successor.
